TERMS, CONDITIONS & CLIENT WAIVER AGREEMENT

This Agreement is made between you (“Client”) and Cryohealthcare Marina del Rey, a wellness spa located in Marina del Rey, Los Angeles County, California, and governs your use of the facility, services (including but not limited to whole-body cryotherapy, localized cryotherapy, near-infrared/red light therapy, Bemer PEMF bed, vitamin injections, cryo t-shock, cryofacials and NAD+), and premises. By scheduling, entering the premises, or receiving any service, you represent that you have read, understand, and agree to all provisions herein.

1. Eligibility, Disclosure & Contraindications

1.1 You certify that you are at least eighteen (18) years of age and competent to sign this Agreement. If under 18, a parent or legal guardian must sign.

1.2 You agree to disclose truthfully all relevant medical conditions, past and current, including but not limited to:

  • Cardiovascular disease, hypertension, arrhythmia, recent heart attack or stroke
  • Pacemaker or implanted electronic device
  • Circulatory disorders (e.g. peripheral arterial disease, DVT)
  • Respiratory conditions, uncontrolled asthma, COPD, etc.
  • Cold sensitivity disorders (e.g. Raynaud’s), bleeding disorders, severe anemia
  • Skin conditions, open wounds, infections
  • Pregnancy or breastfeeding
  • Other conditions your physician advises against exposure to cold or temperature extremes

1.3 If you are uncertain whether any medical condition you have is a contraindication, you agree to seek medical advice and obtain written clearance before receiving any cryotherapy or related treatment.

2. Assumption of Risk

2.1 You acknowledge that services offered involve risks, including but not limited to frostbite, cold burn, hypothermia, slips or falls, dizziness, skin irritation, adverse reactions, aggravation of existing medical conditions, fainting, or other injury.

2.2 You accept and assume full responsibility for all such risks, whether known or unknown, foreseeable or unforeseeable, inherent or resulting from negligence of the spa, its employees, contractors, or affiliates, except to the extent caused by gross negligence or intentional misconduct, which California law does not allow you to waive.

3. Waiver, Release & Indemnification

3.1 To the fullest extent permitted under California law, you release, waive, discharge Cryohealthcare Marina del Rey, its owners, officers, employees, agents, contractors, and affiliates from any and all liability, claims, demands, or causes of action arising out of your use of services, facility, equipment or premises, including injury, damage, loss, or other consequences arising from negligence, except gross negligence or intentional wrongdoing.

3.2 You agree to indemnify, defend, and hold harmless Cryohealthcare Marina del Rey and its affiliates from any claims, liabilities, damages, or expenses (including attorneys’ fees) arising from your breach of this Agreement or your negligent or willful acts or omissions.

4. Services, Booking, Payment & Cancellation

  • 4.1 Cryo t-shock must be booked in advance; all other services can be booked in advance, and walk-ins are also welcome.
  • 4.2 Payment is due at the time of service or per the terms of the package or membership. Acceptable payment methods: Debit Cards, Credit Cards, Cash, VISA, American Express, and Mastercard.
  • 4.3 Cancellations or rescheduling require at least 48 hours’ notice; failure to provide such may incur a cancellation fee equivalent to $75.
  • 4.4 Pre-paid packages, memberships, or multi-session deals must be used within 12 months of purchase unless otherwise agreed; unused sessions after expiry are forfeited.

5. Facility Rules & Safety Protocols

  • 5.1 You agree to comply with all safety instructions, protocols, and warnings provided by staff.
  • 5.2 Appropriate attire is required; remove jewelry or wet clothing; do not use lotions, oils, or substances that may affect safety or hygiene as directed by staff.
  • 5.3 Personal belongings brought to the facility are at your own risk; Cryohealthcare Marina del Rey is not responsible for loss, theft, or damage of personal property.
  • 5.4 Cryohealthcare Marina del Rey reserves the right to refuse or terminate services without refund if rules are violated or if the client appears under the influence of alcohol, drugs, or otherwise unable to participate safely.

6. No Medical Advice or Guarantees

6.1 The services are for wellness, recovery, and relaxation only. They are not medical treatments; no staff member is providing you with a medical diagnosis or treatment unless otherwise explicitly disclosed and performed by licensed medical personnel under separate agreement.

6.2 Results vary by individual. Cryohealthcare Marina del Rey does not guarantee specific outcomes.

7. Privacy, Media & Recording

7.1 You consent to the collection and storage of personal data, including medical disclosures, as necessary to provide safe services. Data will be handled in accordance with California state law, including the California Consumer Privacy Act (CCPA) if applicable, and any relevant federal statutes.

7.2 With your explicit consent, staff may photograph/video during your session for internal or marketing use. You may refuse.

8. Governing Law, Venue & Dispute Resolution

8.1 This Agreement is governed by the laws of the State of California.

8.2 Any claim, lawsuit, or dispute arising from or relating to this Agreement shall be brought in the state or federal courts located in Los Angeles County, California.

9. Severability & Modification

9.1 If any provision of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid.

9.2 Cryohealthcare Marina del Rey reserves the right to modify these Terms, Conditions & Waiver at any time. Changes will be posted in the facility and/or on the website. Continued use after such changes constitutes acceptance.

10. Client Acknowledgement

By scheduling, entering the premises, or receiving services, you acknowledge that you have read and understood this Agreement, accept all risks described, confirm the accuracy of your medical disclosures, and agree voluntarily to these Terms, Conditions & Waiver.
